Juneau County Arrest Records

Under Wisconsin Statutes § 968.07, a law enforcement officer in Juneau County, Wisconsin, may arrest an individual under the following circumstances:

  • They possess a warrant ordering the individual’s arrest.
  • They have reasonable grounds to believe that a warrant for the individual’s arrest has been issued within Wisconsin or a felony warrant for the individual’s arrest has been issued in another state.
  • They have reasonable grounds to believe the individual is committing or has previously committed a crime.

Following an arrest, the individual is typically booked into jail. During the booking process, they will be asked to provide personal information, including their full name, address, phone number, social security number, and medical and mental health history details. The officer usually takes the individual’s fingerprints and booking photographs (mugshots). All information collected and details about the arrest are used to create an arrest record. The Juneau County Sheriff’s Office records department will maintain a copy of the record and forward a copy to the court handling the case. The court will incorporate the arrest information into the Juneau County court records, which are made accessible to the public.

Are Arrest Records Public in Juneau County?

Yes, The Wisconsin Public Records Law permits individuals to access arrest records provided they satisfy the requirements set by the legislature. However, some records are open to only the subjects of records, their legal representatives, and anyone with a court order. Generally, any record that reveals the identities of law enforcement informants is confidential. Investigative and juvenile arrest records are also non-public.

Juneau County Arrest Statistics

The Wisconsin Department of Justice (DOJ) has a Criminal History Repository where individuals can find arrest statistics of law enforcement agencies in Juneau County. The 2024 statistics show that about 836 arrests occurred in Juneau County, 295 of which were felony arrests and 710 were misdemeanor arrests. About 230 of those arrested were females, while 606 were males.

The Juneau County Sheriff’s Office collaborates with a third-party vendor to offer free online access to arrest records, searchable by name and location. Other third-party vendors also provide free access to Juneau County arrest records, but users will only receive basic information. Those who pay the required fee can obtain complete arrest records. Since most third-party sites may contain errors, users should exercise caution when using the information they retrieve from these platforms.

How Long Do Arrests Stay on Your Record?

Juneau County law enforcement agencies permanently maintain certain arrest records, such as fingerprint cards, booking sheets, and mugshots. However, some documents, like bond receipts, are typically removed after a predetermined period. The Wisconsin Circuit Court Access (WCCA) website follows a policy of eliminating arrest records for felony offenses after 50 years and those for misdemeanor offenses after 20 years.

Expunge Juneau County Arrest Records

WI Stat § 973.015 defines expungement as removing or obliterating all references to a person’s name and identity from an arrest record. When a record is expunged, the court seals the person’s entire criminal case file and restricts it from anyone except those with a court order. The Juneau County Clerk of Circuit Court can expunge arrest records in three situations:

  • Juvenile cases when the subject reaches the age of 17 (Wis. Stat. § 938.355(4m))
  • Misdemeanors or certain felonies committed by youthful offenders when the sentence is fully completed (Wis. Stats. § 973.015)
  • Victims of human trafficking who committed a commercial sex act (Wis. Stat. § 973.015(2m)).

Juneau County Arrest Warrants

Under WI Stat § 968.04, a Juneau County judge may issue an arrest warrant if a complaint or affidavit establishes probable cause to believe the defendant has committed an offense. The judge delivers the warrant to a law enforcement officer for service and may specify the geographical limits for the enforcement of the warrant. The officer is typically required to return the warrant to a judge in the county where the offense described in the complaint allegedly occurred. A warrant issued in Juneau County must be in writing and signed by the issuing judge. It should have a copy of the complaint attached to it and contain the following information:

  • The name of the crime, the section charged, and the number of the section violated by the defendant.
  • The defendant's name is known. However, if the name is unknown, the judges can provide a designated name or an identifying description.
  • The warrant issuing date, the name of the judge, and the title of their office.
  • A command that the defendant be arrested and brought before the issuing judge. However, if the issuing judge is absent, the defendant can be brought before another judge in the county.

Do Juneau County Arrest Warrants Expire?

In Juneau County, arrest warrants do not expire. However, the court may cancel a warrant before it is executed if circumstances change. Once the defendant is arrested, the warrant becomes inactive. Although arrest warrants remain valid indefinitely, the statute of limitations for the associated crime may restrict the time the court has to prosecute the defendant.
