According to WI Stat § 968.07, an Outagamie County law enforcement officer can arrest a resident when:
- They have a warrant commanding that the person be arrested.
- They have reasonable grounds to believe that a warrant has been issued for the person's arrest in Wisconsin.
- They have reasonable grounds to believe that a felony warrant for the person's arrest has been issued in another state.
- They have probable cause to believe that the person is committing or has committed a crime.
The Outagamie County Sheriff’s Office requires all arresting officers to record all information associated with an arrest during booking. Therefore, the officer will take the accused to the police station to be booked. The booking process involves entering the arrestee’s personal information in the system and taking their fingerprints and mugshots. This information is available to requesters because it is considered part of public records. Requesters can easily access the arrestee's personal information, the arrest date, time and location, and the arresting officer’s name. - Record seekers can find arrest records online and in person at the Federal Bureau of Prisons (BOP). Online requests can be made using the Inmate Locator. Users can conduct a search by number (BOP register number, DCDC number, FBI number, or INS number) or name (first, middle, or last). In-person requesters can visit the specific BOP facility where the inmate is housed to obtain copies of arrest records.
- The U.S. Immigration and Customs Enforcement (ICE) issues arrest records to the public through the Online Detainee Locator System. A search can be conducted using A-Number or biographical information. ICE also conducts in-person arrest records searches at its field offices or detention facilities.
- The Federal Bureau of Investigation (FBI) also disseminates copies of their arrest records online. Individuals retrieving arrest records online must visit a participating U.S. Post Office location to submit their fingerprints electronically. The processing time is 15 days. The FBI also provides access to arrest records by mail and through approved channelers. Copies of arrest records cost $18 and are payable by certified check, money order, or credit card using the Credit Card Payment Form. Free Arrest Record Search in Outagamie County
Record seekers can find arrest records online or by phone at the Outagamie County Sheriff’s Office without paying a fee. Online requesters should click the Jail Inmate List link on the website to conduct their search. The link provides the arrest information of inmates in alphabetical order, and it is refreshed every 30 minutes. Users should try to access the link during the Outagamie County MIS Department business hours (7:30 a.m. to 4:30 p.m.) to avoid errors. Get Outagamie County Criminal Records
According to Wisconsin law, the Wisconsin Department of Justice (DOJ) can make adult criminal records publicly available, but juvenile criminal records are deemed confidential. However, juvenile criminal records are available available online for daycare background checks. Eligible individuals must have a valid Facility ID number issued by the Wisconsin Department of Children and Families (DCF) to conduct the search.
Outagamie County residents can get their criminal records online or by mail at the DOJ’s Crime Information Bureau (CIB). Outagamie County Arrest Records Vs. Criminal Records
An arrest record only provides basic information about a person’s apprehension by an Outagamie County law enforcement officer. Conversely, a criminal record contains detailed information about a person’s arrest, charge, prosecution, court findings, sentences, and state correctional system admissions and releases.
How Long Do Arrests Stay on Your Record?
When a person gets convicted of a crime in Outagamie County, their arrests remain on record permanently. However, Wisconsin law permits arrested persons to restrict public access to their arrest records through expungement. The Wisconsin Circuit Court Access (WCCA) website provides access to the retention schedule of some arrest information. For example, the website keeps arrests for misdemeanor offenses for 20 years and those for felony offenses t for 50 years. Arrests for Class A felony crimes are on file for about 75 years. Below are other examples of the retention periods of some arrest records:
- Mugshots, booking sheets, and fingerprint cards are permanent
- Bond receipts are kept for 8 years
- Juvenile cards are kept until the juvenile's 18th birthday, plus one year
- Arrest records, dockets, and daily jail records are kept for 8 years
- Warrant cards are kept until warrant cancellation plus a year
- Internal investigation files are kept until the death of the defendant unless the case is still pending plus one year.
- Inmate files, daily inmate rosters, and incarceration files are kept until the inmate's release plus 8 years.
Expunge Outagamie County Arrest Records
The Outagamie County Clerk of Circuit Courts defines expungement as the official and formal deletion of an arrest record or its partial contents. Some adult arrest records may be eligible for expungement during sentencing. This is because Wisconsin law disallows expungement of adult arrest records after sentencing. Per WI Stat § 973.015, an Outagamie County court may order the expungement of a person's arrest records at the time of sentencing if they meet the following eligibility criteria:
- The person was under the age of 25 when they committed an offense for which they were found guilty and were sentenced to a maximum jail term of 6 years or less.
- A person under the age of 18 committed an offense that violates WI Stat § 942.08 (2) (b), (c), or (d) or (3) and has successfully completed their sentence.
- A person has successfully completed the conditions of their sentence and probation have not been convicted of a subsequent offense.
- The person is guilty of committing a commercial sex act as a victim of human trafficking (Wis. Stat. § 973.015(2m)).
No court in Outagamie County will order the expungement of any of the following conviction records:
- A Class H felony when the person has been convicted of a felony crime before or if the felony is a violent crime (WI Stat §301.048 (2) (bm)) or is a violation of WI Stat §940.32, 948.03 (2), (3), or (5) (a) 1., 2., 3., or 4., or 948.095.)
- A Class I felony when the person has been convicted of a felony crime before or if the felony is a violent crime (WI Stat §301.048 (2) (bm)) or is a violation of WI Stat § 948.23 (1) (a).
A detaining or probationary authority will issue a certificate of discharge to the appropriate court to expunge the arrest records of individuals who have successfully completed their sentence or probation and have not been convicted of a subsequent offense. However, individuals sentenced by a court to pay a fine or restitution can expunge their arrest records by filing a Petition to Expunge Court Record of Conviction (Non-Probation/ Non-Incarceration) form with the Outagamie County Circuit Court. To expunge juvenile arrest records, subjects of records or their parents can file a Petition to Expunge Court Record of Adjudication/ Recommendation of District Attorney form.
The Wisconsin Department of Justice (DOJ) Crime Information Bureau (CIB) also handles the expungement of arrest information from criminal records. However, only arrested persons whose charges were dismissed or acquitted are eligible for such. Eligible arrestees can mail a completed Fingerprint Record Removal Request (DJ-LE-250B) form to the CIB.
Outagamie County Arrest Warrants
Pursuant to WI Stat § 968.04, an arrest warrant is issued upon filing a complaint with the court, an affidavit(s) filed with the complaint, or an examination under oath of the complainant or witnesses. The judge will only issue an arrest warrant when there are good grounds to believe that an offense has been committed and that the defendant is responsible. An arrest warrant issued in Outagamie County is usually in writing and carries the judge’s signature. It usually:
- States the name of the crime committed by the accused and the charge and the number of the section violated by the person.
- Has a copy of the complaint attached to it.
- States the defendant’s name if known. However, an identifiable description of the defendant may be provided if the name is unknown.
- States the issuing date, the judge’s name, and the title of the judge's office.
- Commands that the defendant be arrested and brought before the issuing judge or any other judge in Outagamie County.
An arrest warrant is usually directed to all law enforcement officers in Wisconsin and can be served anywhere in the state. After the arrest, the executing officer must endorse the time and place of the arrest, as well as their fees and mileage, upon the arrest warrant.

Do Outagamie County Arrest Warrants Expire?
No, they do not expire. Although they can be recalled or canceled by the issuing judge under certain circumstances. Generally, arrest warrants only become invalid after execution.
